1. GENERAL TERMS

The holder of all rights to the internet domain www.zlatarna-dodic.hr is Zlatarna Dodić d.o.o. By using ZLATARNA DODIĆ Web Shop and all linked pages in the www.zlatarna-dodic.hr domain, consumers are deemed to be familiar with these Terms of Purchase at any time (hereafter: Terms) and to fully understand and accept them. These Terms apply to the rights and obligations relating to the purchase of products through the ZLATARNA DODIĆ Web Shop and the rights and obligations arising from Distance Selling Contract (hereinafter: the Contract) between the consumer as the final customer and the ZLATARNA DODIĆ Web Shop and are considered to be an integral part of such contracts.

Internet service provider through ZLATARNA DODIĆ Web Shop is the company Zlatarna Dodić d.o.o., Avenija Dubrava 2, 10 040 Zagreb, Croatia, OIB: 27291523570.

Users are advised to get acquainted with the Terms before making a purchase and to keep up with them regularly, in order to be aware of their rights and obligations. Zlatarna Dodić d.o.o. reserves the right to change the Terms with no prior announcement and shall not be liable for any damages resulting from making the changes. The mentioned changes become valid once they are published on the Internet site.

Zlatarna Dodić d.o.o. reserves the right to cancel and alter the content as well as all services and sub-pages that are a part of the ZLATARNA DODIĆ Web Shop without prior notice and will not be liable for any possible consequences resulting from such changes. The changes take effect once they are published on the web site.  Zlatarna Dodić d.o.o. reserves the right to modify, restrict or terminate the ZLATARNA DODIĆ Web Shop service at any time without prior notice, including, in whole or in part, restricting access to the ZLATARNA DODIĆ Web Store and to provide certain services in the event of a violation of the terms of these Terms.

Using the services of ZLATARNA DODIĆ Web Shop is only for adult persons. Using the ZLATARNA DODIĆ Web Shop by underage persons is forbidden and parent and / or legal guardians must take that into account. Otherwise, they assume all rights and obligations arising from such use and Zlatarna Dodić d.o.o. is not responsible for any consequences of such use. Furthermore, the sale of products offered on the domain www.zlatarna-dodic.hr on behalf of and for the account of an underage person or a person without legal capacity can be concluded only by their legal representatives, and persons with a partial legal capacity can enter into a contract only with the approval of their legal representative.

ZLATARNA DODIĆ Web Shop is entirely not responsible for the accuracy and /or entirety of all information and content present on the domain www.zlatarna-dodic.hr. ZLATARNA DODIĆ Web Shop reserves the right to make a mistake in pictures and descriptions.

2. ONLINE SHOPPING THROUGH “ZLATARNA DODIĆ Web Shop”

ENTERING INTO A CONTRACT AND TERMINATION OF SALE CONTRACT

These Terms and Conditions, as well as certain sales terms stated with information on certain products, represent the offer of Zlatarna Dodić d.o.o. for the conclusion of the Contract and customers are deemed to accept the terms by registering, ordering or in any other manner determined in these Terms, and it is considered that the customer entered into a contract with the company Zlatarna Dodić d.o.o. under the terms of the sale specified in these Terms.

By registering on ZLATARNA DODIĆ Web Shop and / or signing up for the Newsletter, the User gives consent to ZLATARNA DODIĆ Web Shop, which can send promotional emails regarding the promotion of services and products as well as information on changes or additions to the web site, discounts, sales, products or changes in providing the service. The User can, at any moment, change their mind and unsubscribe from the mailing list for the Newsletter.

The purpose of the Contract is to purchase the selected product through the ZLATARNA DODIĆ Web Shop by paying the appropriate fee(s) for this product and the associated price of delivery of the said product. The contract is concluded by means of distance communication (Distance contract) via: ordering on ZLATARNA DODIĆ Web shop, printed promotional messages with the order, through human mediation by phone or Facebook fan site of the Zlatarna Dodić brand. The User is entitled to choose the manner by which the Seller can inform them of new products, products at sale and so on (newsletter). After a successful registration (once all required information is properly filled in), an email about a successful registration will be sent to the User’s e-mail address. Products that can be purchased are advertised on the domain www.zlatarna-dodic.hr, and each product specifies the product specification and the price. Price and delivery terms are listed in the Delivery section.

All prices of the products on the website www.zlatarna-dodic.hr are expressed in Croatian kuna (HRK) with Value Added Tax (VAT) included. Prior to signing up for a contract, the User has the opportunity to review the Terms by clicking on the Sale Terms section. This Contract will become valid and shall be binding from the moment when the User accepts the of Zlatarna Dodić d.o.o. in one of the following ways:

• choosing payment and completing the order as a registered User of ZLATARNA DODIĆ Web Shop,
• choosing payment and completing the order as guest User of ZLATARNA DODIĆ Web Shop,
• by selecting payment and completing / changing order by telephone at 099/2911-891, on business days from 8 a.m. until 4 p.m. or by mail (inbox) of Facebook fan pages Zlatarna Dodić.

In the process of registration or while creating a User account, the User is required to choose the name under which the service (Username) is to be used and to select the security password and enter a valid e-mail address. All the information required to register or create a User account must be true, where the use of other people’s information is expressly forbidden.

A registration or a User account is created for only one person and it is not permitted to communicate the registration information or account to third parties. The User is obliged to keep his / her password and User account information. You are not allowed to use someone else’s registration or account.

For breaching these Terms stated in this Chapter, Zlatarna Dodić d.o.o. reserves the right, at its discretion, to close the registration or a User’s account, with no obligation towards the User or nor is it responsible for any costs or damages.

The contract becomes valid when the User accept the offer to enter into such a contract. The sales contract between the buyer and company Zlatarna Dodić d.o.o. is concluded once the product is paid for.

As the Contract is concluded, the User will be enabled to review it electronically and/or a message will be sent to the User’s email address containing: the confirmation of the contract concluded, or a pre-contract notice referred to in Article 57, Paragraph 1 of the Consumer Protection Act (Official Gazette 41 / 14), Conditions and the notice of User’s Right to unilaterally terminate the Contract based on article 61, Paragraphs 1 and 2 of the Consumer Protection Act.

The Customer / Buyer may unilaterally terminate the Contract within 14 (fourteen) days without giving reasons. According to Art. 79 (1) of the Consumer Protection Act (OG, 41/14), the User is not entitled to unilaterally terminate the Contract if the service is entirely fulfilled and the fulfillment commenced with the buyer’s explicit prior consent and confirmation that the buyer is made aware of the fact that they will lose the right to unilaterally terminate the Contract if its service is fulfilled in its entirety.

In order for the Buyer to exercise the right to unilaterally terminate the Contract, they must notify Zlatarna Dodić d.o.o. about their decision to terminate the Contract unilaterally before the expiry of the deadline by sending an unequivocal statement by post (to Zlatarna Dodić d.o.o., Avenija Dubrava 2, 10 040 Zagreb, Croatia) or by e-mail at: webshop@zlatarna-dodic.hr, that the statement must state the buyer’s name and last name, address, phone number and email address, order number or account. Unilateral Contract Termination Form located on the ZLATARNA DODIĆ Web Shop website under the terms of the Sales Terms The Customer may be electronically filled in and sent the Zlatarna Dodić d.o.o. The time-limit for a unilateral termination of the Contract is 14 (fourteen) days from the date on which the Buyer or a third person designated by the Buyer and who is not the carrier receive the goods that are the subject of the Contract, i.e. in the case ofa  service, from the day the contract was concluded.

If the User unilaterally terminates the Contract, he will be refunded for the amount he paid, including the costs of delivery, without delay, an no later than 14 (fourteen) days from the day Zlatarna Dodić d.o.o., that is, ZLATARNA DODIĆ Web Shop, receives the User’s decision to unilaterally terminate to contract. The refund will be done in the same way the User paid for the products. In case the User accepts other methods of refund, the User does not bear any costs regarding the refund. Zlatarna Dodić d.o.o. can proceed with the refund only after the product has been returned or after receiving proof that the product was sent back.

In case the buyer wants to return the goods, they are obligated to hand them in or send them to Zlatarna Dodić d.o.o. address (for ZLATARNA DODIĆ Web Shop), Avenija Dubrava 2, 10 040 Zagreb, Croatia, without unnecessary delays and at the latest 14 (fourteen) days from the day the buyer sent its unilateral decision to terminate the contract to Zlatarna Dodić d.o.o. that is, ZLATARNA DODIĆ Web Shop. After 14 (fourteen) days, the costs of return are covered by the buyer, in accordance with the Customer protection Act (OG 41/14, Article 77).  The buyer is responsible for any decrease in the value of the goods which is the result of handling and using the product.

If, upon Customer’s request, the execution of the service commenced during the unilateral termination of the Contract, the Buyer is obligated to pay Zlatarna Dodić d.o.o. the cost of goods already delivered by the time the Customer has notified Zlatarna Dodić d.o.o. about the unilateral termination of the Contract. CONDITIONS FOR SHOPPING

The basic characteristics of the product, the price, the special sales and the discount, the means of payment and the delivery are related to the above conditions which are valid at the time the order is concluded. The above data will be marked with each product. The product price, including the VAT amount and shipping cost, is visible in the shopping cart before ordering. The shipping cost may be visible even on some other parts of the site. All purchase order confirmation information, based on an electronic order, will be delivered to the customer’s email address listed in the registration / order form or in the shopping cart at check-out. All prices are expressed in EUR. All prices of products and services offered on www.zlatarna-dodic.hr include 25% VAT applicable in Croatia.

Zlatarna Dodić d.o.o. treats the selected products in the basket of a registered or unregistered User as an order and reserves the right to cancel it for a justified reason. In the event of a cancellation of the order, the ZLATARNA DODIĆ Web Shop managers will notify the User of their email address or the registered contact phone by indicating the reasons stated herein.

If the Buyer does not receive the Order Confirmation Notice, there is a possibility that he has entered the email address incorrectly. In this case, the Buyer can contact the ZLATARNA DODIĆ Web Shop at: webshop@zlatarna-dodic.hr or on the phone number 099/2911-891, on a working day from 8 a.m. to 4 p.m. for employees to check if the order was received.

At the moment a particular product is ordered, the User/buyer (in accordance with the Consumer Protection Act) confirms that they received all necessary information published on www.zlatarna-dodic.hr (and all its subsites) before concluding the contract and accepting the Terms of sale regarding the name of the company, identification number, the address of the Seller, methods for filing complaints, information on products and their names, main characterizes and the prices, including all tax and other duties, information on costs of product delivery, as well as information on methods of payment and methods and time of delivery.

The ZLATARNA DODIĆ Web Shop is obliged to provide the Customer / Customer (in accordance with the provisions of the Consumer Protection Act) the confirmation of the above mentioned content in writing as soon as possible and at the latest at the time of delivery of the product. By agreeing to these Terms, the User / Buyer agrees that the confirmation of the prior notice is sent by email to the email address that they has provided as a contact when placing their order.

REPLACEMENTS, COMPLAINTS AND MATERIAL LIABILITY

If the buyer receives the product they want to replace for another product, they can do so by contacting the ZLATARNA DODIĆ Web Shop at 099/2911-891 on a business day from 8 a.m. to 4 p.m. Orders are packaged so that they cannot be damaged by the usual handling during delivery. The buyer should check the package upon delivery and if the packaging has visible material damages or defects, it is recommended that the buyer refuses to receive it, as there is a possibility that the product within such packaging is damaged. By refusing to receive the delivery, the delivery service will return the item to the ZLATARNA DODIĆ Web Shop, noting that the package contains a defect or damage.

If a buyer determines material damage on the product, upon delivery, all complaints can be sent in writing to the email address: webshop@zlatarna-dodic.hr, office: Avenija Dubrava 2, 10 040 Zagreb, or in person on telephone number 099/2911-891, on a business day from 8 a.m. to 4 p.m.

In case of a justified complaint, a contract can be terminated, paid price can be refunded or a product can be replaced. In the event of damage and / or defect of the goods delivered, the Buyer may return the item to the above address so that the complaint can be considered on the basis of physical evidence. If by careful examination it is found that the product has been damaged by a deliberate / accidental mechanical procedure, which happened after the product was inspected and sent to the customer, the complaint will be rejected or disputed. In such a case, the customer’s material responsibility for the purchased product is determined.

Also, in accordance with Article 43 of the Consumer Protection Act (OG 41/41) there is a stipulation that if a material defect appears on the product within six months since the transfer of responsibility on the Buyer (on the day of purchase), and the seller considers that the defect did not exist at the that time, the costs of the defect are covered by the seller. If the material defect appears after six months, but no later than 24 month since the transfer of responsibility to the Buyer/consumer, the costs of acquiring an expert opinion are covered by the consumer or seller, depending on the results of the expert’s opinion. The seller is not liable for material damages on the product that appear after two years since the product was purchased. The product that is being returned must be bought in ZLATARNA DODIĆ Web Shop and preferably, a receipt will be presented as well.
